Terms of Use

The following draft describes proposed Terms of Use ("Terms") for the Grocery Tracker mobile app and any related websites or services (together, the "Service"), provided by Tracker Tech Pty Ltd (ABN 19 694 000 961, ACN 694 000 961) ("Tracker Tech", "we", "us", or "our"). These draft terms have not been approved or given an effective date.

1. Eligibility and accounts

You must be capable of forming a binding contract to use the Service. If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Please notify us promptly at help@trackit.today if you suspect any unauthorised use of your account.

2. Using the Service

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • use the Service in any way that could damage, disable, overburden, or impair it;
  • attempt to gain unauthorised access to any part of the Service, other accounts, or related systems;
  • reverse engineer, decompile, or attempt to extract the source code of the app, except where permitted by law;
  • use automated means to scrape, crawl, or extract data from the Service without our prior written consent; or
  • use the Service to violate any applicable law or the rights of any third party.

3. Pricing and product information

Grocery Tracker displays product and price information gathered from publicly available sources for informational purposes only. We make reasonable efforts to keep this information accurate and up to date, but prices, availability, and promotions change frequently and may be inaccurate, delayed, or out of date by the time you view them. Always confirm current prices and availability with the relevant retailer before making a purchasing decision. Grocery Tracker is not affiliated with, endorsed by, or sponsored by any retailer whose prices may appear in the Service, unless explicitly stated otherwise.

4. Subscriptions and purchases

The Service may offer free and paid features. Where paid features are available, pricing, billing terms, and cancellation options are presented at the time of purchase through the Apple App Store and are governed by Apple's applicable terms in addition to these Terms.

5. Intellectual property

The Service, including its design, text, graphics, logos, and underlying software, is owned by Tracker Tech or our licensors and is protected by intellectual property laws. Except as expressly permitted by these Terms, you may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

6. Third-party services

We may use third-party service providers, such as cloud infrastructure providers, and distribute the app through the Apple App Store, to help operate and deliver the Service. Your use of those third-party services may also be subject to their own terms and policies.

7. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement, to the extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that any information (including pricing information) will be accurate or complete.

8. Limitation of liability

To the maximum extent permitted by law, Tracker Tech will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of the Service. Nothing in these Terms excludes or limits any consumer guarantee or other right that cannot lawfully be excluded or limited under applicable consumer protection law.

9. Termination

We may suspend or terminate your access to the Service at any time if we reasonably believe you have violated these Terms. You may stop using the Service, and delete your account, at any time by contacting us at help@trackit.today.

10. Governing law Draft

The governing law and dispute-resolution forum have not yet been confirmed. This section must be approved before these terms can take effect.

11. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you, such as an in-app notice or an updated "last updated" date at the top of this page. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
